Terms of Service

01Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Apple Standard Licensed Application End User License Agreement ("Apple EULA") also applies to your use of the App. If these terms conflict with the Apple EULA, the Apple EULA prevails to the extent of the conflict. You may not copy, modify, reverse engineer (except where the law allows it), resell or redistribute the App.

The Recorder is provided under the licence included with its source code in the project repository. If no licence file is included, you may use it for your own personal, non-commercial purposes only.

02Your provider account and lawful use

• You must obtain your IPTV service, server address and login details from a provider of your choice. We are not connected with, and do not endorse, any provider.
• You are solely responsible for your agreement with your provider, for any fees, and for confirming that the provider is authorised to distribute the content it offers in your country.
• You may only use the App to play content that you are legally entitled to access.

03Prohibited use

You must not use the App or the Recorder to:

• access, play, record, copy or distribute content that infringes copyright or other rights, or that you are not licensed to receive;
• get around access controls, geographic restrictions or technical protection measures;
• share, rebroadcast, sell or publicly perform recordings or streams;
• use another person's account without permission, or break your provider's terms;
• break any applicable law.

We may stop providing the App, or parts of it, to anyone who misuses it.

04Recording

Recording and catch-up download features are provided only for personal, private, non-commercial time-shifted viewing, and only where this is permitted by the law of your country and by your provider's terms. Recordings stay in the App's storage on your device, on a Recorder you run yourself, or in your own Files app if you export them. You are responsible for any recordings you make and for keeping them private.

05Purchases and subscriptions

• TiviGrid Pro is offered as an auto-renewing monthly or yearly subscription, or as a one-time lifetime purchase. Prices are shown in the App before you buy.
• Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
• You can manage or cancel subscriptions in your Apple Account settings. See Apple's guide to cancelling a subscription.
• All payments, refunds and billing are handled by Apple under its terms. We cannot issue refunds directly; request them from Apple at reportaproblem.apple.com.
• Purchases are governed by the Apple Standard EULA (Terms of Use) and these terms. Family Sharing is supported where Apple makes it available.
• Pro features depend on your provider and device. A purchase does not include any content, channels or provider service.

06Third-party services

The App connects to services we do not control: your provider, guide addresses you add, public channel-logo and guide catalogues, and Apple. We are not responsible for their availability, accuracy, content or practices.

07Disclaimer

The App and the Recorder are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not guarantee that the App will work with every provider, that streams or guide data will be available or correct, or that recordings will always succeed. Do not rely on the App to record anything you cannot afford to miss.

08Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, recordings, profits or goodwill, arising from your use of the App or the Recorder. Our total liability for any claim is limited to the amount you paid for the App and in-app purchases in the 12 months before the claim. Some countries do not allow certain limits, so some of these may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

09Indemnity

You agree to be responsible for, and to compensate us for, claims and costs arising from content you access, play or record with the App, or from your breach of these terms or of the law.

10Copyright and infringement notices

The App does not host, store, index or link to any content, so we cannot remove content from a provider's service. If you are a rights holder and believe the App itself, its listing, its website or its source code infringes your rights, or that the App is being promoted for infringing use, send a notice to support@tivigrid.com with the subject "Copyright notice", including:

1. your name, address, phone number and email address;
2. a description of the copyrighted work or other right you say is infringed;
3. where the infringing material is located (for example a URL or a description of the screen in the App);
4. a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
5. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorised to act for them;
6. your physical or electronic signature.

We will review each complete notice and respond within a reasonable time. Notices about content on a provider's service should be sent to that provider and, where appropriate, to its hosting company. Abuse reports of other kinds can be sent to the same address.

11Changes and termination

We may update the App or these terms. If we make material changes we will update this page and the effective date. You may stop using the App at any time. These terms end automatically if you break them; sections 3, 7, 8, 9 and 12 continue to apply after they end.

12Governing law

These terms are governed by the laws of [GOVERNING LAW / COUNTRY], without regard to conflict-of-law rules. Courts in [JURISDICTION / CITY] have jurisdiction, except where consumer protection law gives you the right to bring a claim in your own country.
